RESOLUTIONS Resolution 25-773 Agenda Item 10.4 DEFEATED 1-8 (Hulings) A Resolution authorizing the sale of vacant property located at 207 7th Street pursuant to N.J.S.A. 40A:12-13(a) and 40A:12-13.1. To authorize the sale of the vacant Jersey City Police Department building located at 207 7th street at public auction to highest bidder. N.J.S.A. 40A:12-13(a) authorizes the City to fix a minimum price for the Property, with or without the reservation of the right to reject all bids where the highest bid is not accepted; and Whereas, the minimum price for the property shall be $4,400,000 Resolution 25-785 Agenda Item 10.16 DEFEATED 0-9 A Resolution of the Jersey City Municipal Council directing the Planning Board to study and prepare an amendment to the Powerhouse Arts Redevelopment Plan in the Rehabilitation Zone for Block 11509 Lot 2 and 3. Study was to establish a new Proposed Zone consists of Lots 3 and the part of Lot 2 that includes the A&P Annex structure and that is not developed with the historically significant Great Atlantic & Pacific Tea Company Headquarters building on Block 11509. Resolution 25-820 A Resolution recognizing Councilman Boggiano’s 50 years of Public Service with the City of Jersey City & designating the corner of Magnolia and Baldwin Avenue as "Richard Boggiano Junction". Letter dated December 5, 2025 from Council President Watterman to the Municipal Council: Councilman Boggiano has also been appointed as Member of the Board of Trustees for the Friends of Loew's, for a term to commence on this date and expire on December 5, 2026. REPORTS OF DIRECTORS VETOED BIRD ORDINANCE There was no additional discussion on this item, aside from public comment. Agenda item 8.1 Letter dated December 4, 2025 from Steven M. Fulop, Mayor to Council President re: Veto of Ordinance 25-123 The adopted ordinance for bird friendly materials has been vetoed by Mayor Fulop, citing the reasons below for the rarely used vetoed authority. It is unknown when but highly likely this ordinance will resurface with the new administration as the ordinance was initially sponsored by Mayor-elect James Solomon. The details of the vetoed ordinance is included below in this update for reference. X.com post (also posted on Facebook) from Mayor Fulop: I vetoed the #JerseyCity bird-friendly façade ordinance because adding new mandates that drive up construction costs makes housing less affordable. If we want more homes, more union jobs, and real supply, we can’t keep layering on costs that push projects off the table. I support protecting wildlife, but not at the expense of housing affordability. The proposed bird-friendly window mandate would have added real costs to new buildings. An Ordinance Authorizing the City of Jersey City to enter into a lease/purchase agreement as Lessee with Jackson Square Office LLC, as lessor, for a nine-story office building to be constructed between Orient Avenue and Kearney Avenue on Martin Luther King Drive and ancillary improvements throughout Jackson Square. Agenda Item 4.2 - Ordinance 25-119 INTRODUCED 9-0 November 12 Carried to December 10 meeting TABLED 9-0 December 10 (This item will have to be reintroduced by next Administration.) A Bond Ordinance providing for various Capital Improvements by and in the City of Jersey City, in the County of Hudson, State of New Jersey; reappropriating $58,393,447.96 in excess Bond or Note proceeds from various Bond Ordinances, not needed for their original purpose, to finance the cost thereof. Agenda Item 4.3 - Ordinance 25-124 INTRODUCED 8-0-1 (Saleh) November 12 Carried to December 10 meeting ADOPTED 8-0-1 (Saleh) Ordinance amending Chapter 345 (ZONING), Section 52 regarding permitted uses in the Medical Zone. This item was carried to December 10 as it is on the agenda for the Planning Board meeting also scheduled for Nov.25. The ordinance is to adopt an amendment to the Medical zone to ensure that the zones are used for hospital purposes only, not permanent senior housing. Memo dated Nov. 14 from Director Marione to the Planning Board Commissioners includes a Medical District Overlay: A. Medical Overlay Zones (MDZ) shall apply to the areas depicted on the Jersey City Zoning Map. The MDZ is intended to provide for the limited expansion of necessary health and community facilities in areas where there are established hospital uses B. Permitted principal uses are as follows: 1. Hospitals. 2. Medical offices. 3. Ambulatory care facilities. 4. Diagnostic centers. 5. Rehabilitation centers. 6. Nursing homes. 7. Schools A. Uses incidental and accessory to the principal use: As permitted in the M- Medical District. B. Bulk and Parking Standards: As permitted in the M - Medical District. C. Permitted conditional uses: 1. Senior Housing and Assisted Living, subject to the following conditions: a. All sites rezoned by Ordinance in December 2025 that are proposed Senior Housing are subject to Chapter 187, the Inclusionary Zoning Ordinance b. Maximum height: 5 stories and 55 feet c. Maximum lot coverage: 90% d. Rooftop decks must be setback a minimum of five feet from the side property line and a minimum ten feet setback from the front and rear of the roof. Rooftop deck shall not cover more than 30 percent of the roof inclusive of the setback requirements herein. Where an inaccessible green roof is installed for stormwater detention, a rooftop deck is permitted an increase in coverage but shall not cover more that 50 percent of the roof, inclusive of the setback requirements herein, and provided that the remaining areas of the roof is a green roof. e. Resident Parking: Not permitted on lots 50 feet wide or less. f. Employee Parking: Maximum of 1 space per 1,000 square feet of office. Agenda Item 4.4 - Ordinance 25-127 INTRODUCED 8-0 November 25 ADOPTED 9-0 December 10 Amending Chapter A350 Council Rules Order. The Council shall hold its regular meetings each year during the months of January through December inclusive, except for the months of July,and August, and December on the second and fourth Wednesdays of each month at 6:00 p.m. Any person may address the Council on any subject of interest during the Public Request for Hearing portion of each Council meeting. Anyone who wishes to address the Council during this portion of the meeting must register with the City Clerk no later than two hours (2) hours prior to the scheduled start of the Council meeting by providing their name, and telephone number to the City Clerk through the City’s webpage. The countdown timer shall not be stopped for any questions asked during the public hearing, unless the Council President gives the explicit direction to stop the time. The Council President and the Council may elect not to answer questions during the public hearing portion. Agenda Item 4.6 - Ordinance 25-129 INTRODUCED 8-0 November 25 DEFEATED 1-6-2 December 10 (Ridley-6-Hulings, Boggiano) An Ordinance Of The Jersey City Municipal Council Amending The Jersey City The Official Zoning Map And Incorporation Of IZO Compliance Provisions VIDEO Nov. 24 Caucus Mtg: Matt Ward and discussion related to 25-129 The removal of the R-3 District is included in the updated ordinance. Update to the Official Zoning Map regarding properties in and around Upper Route 139 and inclusion of IZO Compliance Provisions to make it clear if future developments in these areas exceed 14 units, that onsite affordable housing will be required. Previous versions of this rezoning map were sent to community groups and council people and comments were incorporated. The Planning Board recommends adoption of this ordinance and confirmed it comports with the goals and objectives of the Master Plan. Agenda Item 4.7 - Ordinance 25-130 INTRODUCED 8-0 November 25 ADOPTED 9-0 December 10 Ordinance of the City of Jersey City authorizing the City of Jersey City to enter into a Lease agreement with the Exchange Place Alliance District Management Corporation for space at 335 Washington Street. This is a building dedicated to the city as part of a development project (across the street from the powerhouse). Exchange Place Alliance will outfit the space as a community art and performance space. Agenda Item 4.8 - Ordinance 25-131 INTRODUCED 8-0 November 25 ADOPTED 9-0 December 10An Ordinance Establishing the Jersey City Accessibility Advisory Committee Establishment of The Accessibility Advisory Board is an advisory body to make the city more accessible for citizens with disabilities, raise awareness regarding challenges facing residents with disabilities in Jersey City, and promote stronger ties between persons with disabilities, advocacy groups, community organizations, and the public. The Board shall consist of 11 members to be appointed by the Mayor with the advice and consent of the Municipal Council. All members shall be citizens and residents of Jersey City. The Mayor and Council President shall serve as ex officio members of the Board. Purpose and powers of the Board include: Address barriers preventing equal access by citizens with disabilities to public parking, education, recreation, transportation, employment, housing, pedestrian travel, municipal programs, facilities, etc. Promote continued compliance with the Americans with Disabilities Act for all public buildings and properties and make recommendations on any various political issues, needs, and design of buildings, properties, and projects in the future. Create a Special Needs Registry that allows citizens to notify first responders of their needs so they can be accommodated during an emergency. |

Fulop, Mayor to Council President re: Veto of Ordinance 25-123 INTRODUCED 9-0 November 12 ADOPTED 7-0-1 (Hulings) November 25 VETOED December 4 Mayor Fulop An Ordinance of the Jersey City Municipal Council amending the Jersey City Land Development Ordinance, Chapter 345 Article I Section 6 Definitions, Chapter 345 Article V Section 62 Residential Design Standards, and Chapter 345 Article V Section 63 Non-Residential Design Standards. At the September 23, 2025 Meeting of the Planning Board, the Board reviewed and commented on the proposed ordinance listed above. The purpose of the Amendments is to establish bird friendly design standards. BIRD FRIENDLY MATERIAL – A material that has or has been treated to have a Threat Factor less than or equal to 25 in accordance with American Bird Conservancy or complies with American Bird Conservancy’s Prescriptive Rating Criteria; a material with exterior surface obstructed and effectively covered by building-integrated structures that do not have gaps larger than 12” in any dimension, including non-glass double-skin facades, metal screens, fixed solar shading, exterior insect or solar screens; or a material deemed bird friendly in accordance with a relevant standard BIRD HAZARD INSTALLATIONS – Structures that pose significant collision risks to birds such as awnings, railings, noise barriers, and wind barriers; and building features that pose significant collision risks to birds such as skyways or skywalks, pedestrian bridges, all floors of building connectors, atriums, outside corners where a bird can see in one side of the building and out the other within 30 feet of the corner, all interior corners within 30 feet of the corner, glazing adjacent to courtyards, and any portion of a building façade adjacent to a green roof or landscape element up to 24 feet above the surface of the green roof |
